    1. Rental & Use

    The trailer is rented to the individual named in this agreement (“Renter”) by Good Junk / Whatley Brands, LLC (“Owner”). The Renter agrees to use the trailer only for its intended purpose, to obey all traffic and load laws, and to keep gross weight within the trailer's posted rating. The trailer may not be sublet, loaned, or operated outside the State of South Carolina without written consent.

    2. Driver Qualification & Insurance

    Renter certifies they hold a valid driver's license (photos of front and back uploaded with this agreement) and carry liability insurance covering the tow vehicle and any attached trailer. Renter agrees their personal auto policy is the primary coverage for any incident involving the trailer.

    3. Inspection & Condition

    Renter has inspected the trailer (tires, lights, coupler, safety chains, jack, and deck) and accepts it in good working order. Any pre-existing damage must be noted in writing at pickup; otherwise the trailer is deemed received in undamaged condition.

    4. Damage to Trailer

    Renter is responsible for the full cost of repair or replacement value of the trailer and any equipment damaged, lost, or stolen during the rental period, regardless of fault, up to and including total replacement cost.

    5. Driveway, Pavement & Property Damage — Release of Liability

    RENTER ACKNOWLEDGES that loaded trailers, jack stands, ramps, tongue jacks, and tow vehicles can crack, dent, gouge, stain, settle, or otherwise damage asphalt, concrete, pavers, gravel, lawns, sprinkler heads, landscaping, septic lids, and other surfaces — including the Renter's OR a third party's driveway. Renter assumes ALL risk of such damage and RELEASES, WAIVES, AND HOLDS HARMLESS Good Junk, Whatley Brands, LLC, its owners, employees, and agents from any and all claims, costs, or liability for damage to driveways, walkways, pavement, yards, landscaping, irrigation, or any other real or personal property arising from delivery, placement, loading, sitting, or pickup of the trailer. This release applies whether damage is caused by the weight of the trailer, contents, tow vehicle, jack, ramp, fluid leaks, or any other cause, and whether the property belongs to Renter, a neighbor, an HOA, or any third party.

    6. Indemnification

    Renter agrees to indemnify, defend, and hold harmless Owner from any third-party claim, suit, fine, attorney's fee, or judgment arising out of Renter's use, possession, towing, loading, or return of the trailer, including but not limited to bodily injury, death, environmental cleanup, property damage, and traffic citations.

    7. Prohibited Loads

    Renter shall NOT load hazardous waste, paint, oil, batteries, tires, asbestos, medical waste, ammunition, propane tanks, or any item prohibited by state or federal law. Renter is solely liable for any disposal fines or cleanup costs incurred.

    8. Return, Late Fees & Cleaning

    Trailer must be returned by the agreed end date in the same clean condition it was received. Late returns are billed at the daily rate plus a $25/day late fee. A cleaning fee of up to $150 may be charged for trailers returned with debris, mud, fluids, or odors.

    9. Repossession

    Owner may repossess the trailer at Renter's expense if any term is breached, including non-payment, prohibited use, or failure to return on time. Renter consents to entry onto property where the trailer is located for the limited purpose of repossession.

    10. Governing Law & Severability

    This agreement is governed by the laws of the State of South Carolina, with venue in Charleston County. If any clause is found unenforceable, the remaining clauses remain in full force.

    11. Electronic Signature

    Renter agrees that the typed and drawn signature submitted below, together with the uploaded driver's license images and timestamp, constitute a legally binding electronic signature under the federal E-SIGN Act and the South Carolina UETA.
